Request: Variance in R-1AA zone to erect two-story accessory building (garage and attic studio) attached to residence by fully enclosed passageway 28 ft. from rear property line in lieu of 35 ft.

Hearing: The applicant is a graphic designer and wants to have a studio above a proposed garage attached to the back of her house. An older out building at the back of the property will be removed. The new building's exterior design and coloration will match that of the house, which is a requirement per Code. Twelve commentaries were received in favor and none in opposition. Staff noted a concern with a proposed full bathroom facility in the studio. A sink is necessary for the graphic design business, and a toilet is understandable. However, there is no need for a shower or bathtub. A neighboring property owner appeared in opposition. He stated he is an architect and had reviewed the plans. His opposition was to the full bathroom facility, stating the studio could potentially be turned into a dwelling unit, in violation of zoning codes. The BZA approved the Variance, with the condition that there be no bathtub or shower.
