Summary of the decision
VA-23-05-024 — Rhona Isgar
Request: Variances in the A-1 zoning district as follows: 1) To allow the conversion of an existing 448 sq. ft. garage to living area with a west side setback of 7.8 ft. in lieu of 10 ft. 2) To allow a north rear setback of 35 ft. in lieu of 50 ft. for an existing house.
Decision: Approved
Hearing: SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for approval. Staff noted that no comments were received in support, and no comments were received in opposition. The applicant had nothing to add. The BZA noted that the property had a unique shape, and the request is correcting what has occurred in the past. Two (2) people spoke in favor of the request. The president of the HOA noted that the request does not increase the footprint of the house, and noted that the house had been vacant for years and needs repairs. A representative of the property to the north stated that they are concerned with the state of the property, and want assurances that it will be cleaned up and secured in the rear. The BZA discussed the variances and stated justification for the six (6) criteria and unanimously recommended approval of the variances by a 5-0 vote, with two absent, subject to the three (3) conditions found in the staff report.
