Request: Variance in C-1 zone to allow alcoholic beverage license (2COP: beer and wine on-premise consumption) 695 ft. in lieu of 1,000 ft. of a school (Union Park Middle School at 1844 Westfall Drive).

Hearing: The applicant stated this is a family-operated business. They want to serve the beer and wine for lunch and dinner. Staff noted a large section of the school's frontage along Colonial Drive is a fenced-in area used for the mass parking of school buses. The actual school facilities where the classrooms and children are located lie well beyond the 1,000 feet separation requirement. Legal representation from the Orange County School Board was present in opposition to this request. The representaive advised that they anticipate the bus parking area be converted for school expansion purposes in the future. In response to this concern, the BZA stipulated the applicant could only serve the alcohol after 5:00pm, by which time children have left school grounds. There was no other opposition to the request.
