Summary of the decision
SE-00-03-003 — Phillip D. Harper
Request: Special Exception in R-CE zone to erect an accessory dwelling unit for grandmother and/or mother-in-law.
Decision: Denied
Hearing: This property is located in the Windermere Heights subdivision. The applicant wants to erect a 2-story accessory dwelling unit for his relatives. The ground level of the unit will be used for storage. Access to the unit will be from Cleveland Street. Staff gave its presentation which included several concerns (See amended Staff Report). In conclusion, Staff felt the request did not meet the intent of the Accessory Dwelling Unit Ordinance. Three (3) residents spoke in opposition to the request. They stated they relied on the current zoning which allows for one (1) home per acre only. The BZA informed the applicant that another unit would be out of character with the area. Staff received one (1) commentary in favor and five (5) in opposition.
