Summary of the decision
VA-04-07-176 — Sam Meiner
Request: Variances in R-1A (single family-7,500 sq. ft. lots) zone to construct first and second story additions to single family residence as follows: 1) 5.75 ft. from front property line in lieu of 25 ft.; 2) 24.75 ft. from Normal High Water Elevation of Lake Killarney in lieu of 30 ft.
Decision: Approved
Hearing: The applicant wants to build one and two story additions onto his existing home. The additions will encroach into the front yard setback and the proposed wooden deck will encroach slightly into the lake setback. The applicant's attorney gave his presentation. He stated the request was consistent with the house to the west which also has a 5 foot setback. In addition, the property is the last house on a dead end roadway. The adjacent neighbor spoke in opposition. She did not object to the front yard variance request. She had concerns about the requested variance on the lake side of the property. The applicant stated his lakeside setback was for a wooden deck, not for any living space. In addition, the adjacent neighbor was opposed because she constructed an illegal seawall which is being resolved by the proper environmental agencies. The BZA concluded the request was reasonable. Staff received 5 commentaries in favor and none in opposition.
