Request: Variance in the R-1 zoning district to construct a 6 ft. high fence in the front yard (Wallington Dr.) in lieu of 4 ft.

Decision: Approved

Hearing: Staff advised the BZA that a Special Exception was approved in May 2016 to allow the subject property to be used as a parking lot for the adjacent commercial property. Part of that approval was a condition to extend a six ft. tall opaque fence along the entire west property line. This constituted a de-facto variance for a six ft. fence in the front setback. Approval of this request would be consistent with that approval. In addition, it would provide superior security to a four ft. fence. Staff is recommending that the applicant plant hedges and standard crepe myrtle trees in the first three ft. along Wallington Dr. The applicant indicated that they were in agreement with the staff recommendation. There being no one present to speak for or against the request, the public hearing was closed. The BZA concluded that the proposed variance would be an enhancement. A motion for approval passed unanimously.
