Request: Variances in the C-3 zoning district as follows: 1) To allow a south front building setback of 15 ft. in lieu of 25 ft. 2) To allow 10 parking spaces in lieu of 21 parking spaces for a 4,110 sq. ft. office building.

Hearing: "SYNOPSIS: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for approval. Staff noted that no comments were received in support, and no comments were received in opposition. The applicant had nothing to add. The BZA confirmed that the billboard will remain and does not cause any constraints. Two neighbors spoke in opposition to the request, noting the increased traffic in the area and expressed concern about additional traffic and accidents. They felt that it would be a detrimental intrusion and wanted the lot to only be landscaped. The applicant noted that the proposed office building would have no more than 10-12 people and will not have a significant impact, and felt that the issue was transportation/traffic. The BZA noted that they understand the concerns of the community, but without granting the variances, the property could not be developed, and noted that there are traffic issues countywide. The BZA discussed the variances and stated justification for the six (6) criteria and unanimously recommended approval of the variances by a 5-0 vote, with two absent, subject to the four (4) conditions found in the staff report."
