Summary of the decision

VA-02-09-105 — Maximilian & Louise Villinger

Request: Variances in R-1AA (single family-10,000 sq. ft. lots) zone to construct two-story room addition to single family residence as follows: 1. 22 ft. from rear property line in lieu of 35 ft.; 2. 48 ft. from NHWE of Little Lake Conway in lieu of 50 ft.

Decision: Approved

Hearing: The request for a room addition involves two variances in the back yard. The subdivision was platted in 1972, prior to the adoption of building setbacks from the normal high water elevation of lakes. The subdivision is unique in that the lakefront lots were platted with rear property lines. This necessitated a Variance not only from the normal high, but also from that platted rear lot line. There were several letters in favor, including one from the homeowners association. There was no opposition at the public hearing.
