Request: Variance in R-1A-C zone to allow existing carport to remain 3.5 ft. from adjacent single family residence in lieu of required 12 ft. separation between residences.

Decision: Denied

Hearing: The applicant constructed a carport without permits and in violation of the zoning laws. The carport is approximately three (3) feet from the adjacent residence. The applicant stated he was unaware he needed permits. The BZA asked the applicant if he noticed other homeowners in his subdivision that had the same encroachment. He answered "no". The most affected neighbor submitted a commentary in opposition as did the Ginger Mill Homeowners Association. Two (2) commentaries were submitted in favor. There was no opposition at the hearing.
