Request: Special Exception in P-O (professional office) and R-1AA (single family-10,000 sq. ft. lots) zones to construct religious use facility and Variance to allow unpaved parking in lieu of paved.

Decision: Approved

Hearing: The Staff Report and Recommendation is located on Pages_____ Staff informed the BZA about the joint use parking agreement between the applicant and Mr. Deochand, who has an appeal pending with the BCC for a Special Exception for a beauty salon adjacent to the west. Staff recommend a condition covering the parking arrangement with on Mr. Ortiz's Special Exception since the subject parking is located on Mr. Ortiz's property. However, the BZA felt that this was a separate issue and that the parking should be addressed more appropriately under Deochand's request versus Ortiz'. Therefore, BZA deleted that condition. Mr. Ortiz indicated he wanted to continue operating the church out of the residence until funds were available to build the new church. Staff advised the BZA they could approve that, but Ortiz would not be able to use it for church purposes until he obtained the appropriate permits to convert the residence to a place of public assembly. The applicant was advised that he would have to relocate his congregation in the meantime or be subject to Code Enforcement action. There was no opposition at the public hearing.
