Request: Special Exception and Variance requests in the A-2 zoning district as follows: 1) Special Exception to allow a landscaping business. 2) Variance to allow parking on an unimproved surface.

Hearing: Staff described the proposal, including the location of the property, the site plan, and photos of the site. Staff provided an analysis of the six (6) criteria and the reasons for a recommendation for denial. Staff noted that no comments were received in support or opposition to the request. The applicant indicated that the business had been operating since prior to 2018, and the original approval expired due to an oversight on their end. The applicant withdrew the Variance request, and noted that they would improve the parking lot with 57 stone as required by County Code. The applicant also stated they would continue to work with staff to provide landscaping in compliance with Chapter 24, and therefore meet Special Exception criteria number 6. There was no one in attendance to speak in favor or in opposition to the request. The BZA discussed the request determining that it was consistent with the existing and surrounding development and unanimously recommended approval of the Special Exception by a 6-0 vote, with 1 absent, subject to the ten (10) conditions found in the staff report, with a modification to Condition #1 as follows:1. Development shall be in accordance with the site plan date stamped January 30, 2025, as modified to reflect the BZA's decision, and all applicable laws, ordinances, and regulations. Any proposed non-substantial deviations, changes, or modifications will be subject to the Zoning Manager's review and approval. Any proposed substantial deviations, changes, or modifications will be subject to a public hearing before the Board of Zoning Adjustment (BZA) where the BZA makes a recommendation to the Board of County Commissioners (BCC).
