Request: Variances in the A-2 zoning district as follows: 1) To validate an existing residence located 8 ft. from the side (west) property line in lieu of 10 ft. 2) To allow an addition 8 ft. from the side (west) property line in lieu of 10 ft.
Decision: Approved
Hearing: Staff noted that due to the age of the home, they were unable to determine whether the home had been constructed as permitted, or if an error occurred in the site of the units foundation. However, since the applicant is not the original owner, the need for the variance was not self-imposed. Further, since the applicant is following the same building line as the existing home, there is not increase in the encroachment, making this the least variance needed. Due to the placement of the screened porch and pool, there is no other logical location to construct the addition. Denying the variance would deprive the applicant of constructing the addition, which is a right commonly enjoyed by other in the same zoning District. Staff noted that two (2) neighbors supported the request, and that there was no correspondence objecting to the request. The applicant indicated there agreement wit the staff recommendation and the conditions. Three being no one present to speak in favor or opposition to the request, the public hearing was closed. The BZA concluded that the request was straight forward and met the criteria for granting of variances. A motion to recommend approval of the variances passed unanimously.
