The lot shape restricts the buildable area for a home addition due to the fifty (50) foot setback required from the lakes normal high water elevation. The applicant submitted a plot plan clearly indicating that the encroachment requested is the minimal necessary to construct a geometrically correct addition to the home. The request was reviewed by the Environmental Protection Division (EPD). The EPD reported no objection to the request. Staff included a hold harmless agreement as a condition of approval to protect the County against claims should the lake ever rise to a level that damaged the applicant's home.
