Summary of the decision
VA-04-05-151 — Joseph Woodbury
Request: Variance in A-1 (agricultural) zone to allow detached accessory building (garage) to remain as follows: 1) 1,917 sq. ft. in size in lieu of 1,000 sq. ft.; 2) 17 ft. in height in lieu of 15 ft.
Decision: Approved
Hearing: The applicant is asking for an existing garage to remain 1,917 sq. ft. in size in lieu of 1,000 sq. ft. and 17 ft. in height in lieu of 15 ft. The applicant was denied a non-conforming use status in February of 2004 for this structure. The applicant claims the structure has existed since the early 1980s. Staff has no approved permits for the structure on file. A homeowner in the area voicing concerns that a business was being conducted from this garage submitted one letter of opposition. The BZA questioned the applicant regarding any business activities being conducted from the garage. The applicant stated he is a collector of antique and racecars, which he stores and maintains in the garage. In addition, the applicant stated that a portion of the garage would be removed decreasing the square footage to 1,400 sq. ft. in lieu of the 1,917 sq. ft. originally requested. There was no opposition present at the public hearing.
