Summary of the decision

VA-05-03-006 — DAVID C. POLING - MARCH 3, 2005

Request: (SE 1/4 of NE 1/4 21-22-30 Tract Size: 111 ft. x 121 ft. District #3)

Decision: Denied

Hearing: The applicant wants to build 4 dwelling units on the property. The code allows up to 3 dwelling units.

Staff advised the BZA this request should not be approved because it did not meet the variance criteria and it was based on economics. The site can develop with 3 dwelling units without the need for any variances.

The applicant addressed the BZA. He advised the BZA the project would comply with all setbacks.

A spokesperson for the Little Lake Barton Homeowners Association spoke in opposition. She advised the BZA that this request would set a precedent for all the vacant lands in the area.

The BZA agreed. They felt the applicant already had a reasonable use of the land.
