Request: Request in a C-1 zone to construct an office building with the following variances: 1. 5 ft. from rear (north) property line in lieu of 15 ft.; 2. Eliminate required landscape buffer on north property line; 3. Provide a 4 ft. wide landscape buffer along Michigan Avenue in lieu of 7 ft.
Decision: Approved
Hearing: The applicant wants to construct a one story office building. The site contains 3 healthy mature oak trees at the center of the site. Rather than remove the trees, the applicant is constructing the office building behind the trees. This creates the need for a rear yard setback variance. The area behind the site is part of the Boone High school expansion area and will be used as outdoor fields. In addition, the variance from the 7 foot wide landscape buffer along the front of the site is compensated for by preserving the 3 trees. Staff supported the request. The BZA felt the preservation of the trees compensated for the variances. There was no opposition.
